1. Agreement

These Terms govern your use of the Perf Budget Guardian Chrome extension (the "Extension"), provided by 3iApps, a trading name of 3D-Prototype Ltd (Company No. 08788558, ICO registration ZA583291), support@3iapps.com. By installing or using the Extension, you agree to these Terms.

2. What the Extension does

Perf Budget Guardian measures Core Web Vitals and related performance metrics on pages you visit and alerts you when a metric exceeds a configured budget. It runs entirely in your browser; see the Privacy Policy for exactly what data is captured and where it is stored.

3. Free tier, Pro, and the free trial

The Extension has a free tier (live capture, toolbar badge, current-page metrics, and default budgets) and a paid Pro tier (session history, alert history and desktop notifications, custom budgets, data export, and retention control). All Pro features run entirely on your device.

You may start one 7-day free trial of Pro per installation. No payment details are taken for the trial, and nothing is charged when it ends — the Extension simply returns to the free tier. Your locally stored data is never deleted when a trial or subscription ends.

4. Subscriptions, billing, and cancellation

Pro is sold as a recurring subscription (currently £3.99 per month or £29 per year, inclusive of any applicable VAT, as shown at checkout). Payments are processed by Stripe; we never see or store your card details. Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from the link in your Stripe receipt email or by contacting support@3iapps.com; cancellation takes effect at the end of the current paid period and no further charges are made.

Prices may change; any change applies only from your next renewal and we will notify you before it takes effect.

5. Right to cancel and refunds

If you are a consumer in the UK or EU, you have a statutory right to cancel within 14 days of purchase under the Consumer Contracts Regulations 2013. Because Pro is digital content supplied immediately on purchase, by completing checkout you request immediate supply and acknowledge that you lose the 14-day right to cancel once the licence key is delivered. Notwithstanding this, if Pro does not work as described and we cannot resolve the issue, contact us within 14 days of purchase and we will refund you in full. Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.

6. Licence keys

On purchase you receive a licence key that activates Pro. The key is for your personal use across your own browsers; please do not share, publish, or resell it. We may revoke keys that are shared, obtained fraudulently, or associated with a refunded or charged-back payment. The Extension periodically confirms your key with our licence service (sending only the key and the Extension version) and continues to work offline for extended periods between checks, as described in the Privacy Policy.

7. Measurements are estimates

Performance metrics reported by the Extension (including the INP approximation) are measured live in your browser and are estimates for guidance. They may differ from lab tools such as Lighthouse, from field data reported elsewhere, or from measurements taken at a different time, on a different device, or under different network conditions. Use the Extension as one signal among others, not as a certified benchmark.

8. Acceptable use

You agree not to reverse engineer, decompile, or attempt to extract the source code of the Extension except as permitted by law; not to use the Extension to attack, overload, or disrupt any website or service; and not to circumvent or attempt to circumvent Pro licensing.

9. Intellectual property

The Extension, its design, and its underlying code are owned by 3D-Prototype Ltd and protected by copyright and other laws. These Terms do not grant you any rights to our trademarks or branding beyond using the Extension as intended.

10. No warranty

The Extension is provided "as is". To the fullest extent permitted by law, we make no warranty that it will be error-free, uninterrupted, or fit for any particular purpose beyond what is described in these Terms.

11. Limitation of liability

To the fullest extent permitted by law, 3D-Prototype Ltd is not liable for any indirect, incidental, or consequential loss arising from your use of the Extension. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.

12. Changes to the Extension or these Terms

We may update the Extension and these Terms from time to time. If we make a material change to these Terms, we will note it in the Extension's changelog. Continuing to use the Extension after a change constitutes acceptance of the updated Terms.

13. Termination

You may stop using the Extension and uninstall it at any time. We may suspend or revoke a licence key for breach of these Terms, including the circumstances described in section 6.

14. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them, without prejudice to any mandatory consumer-protection rights you have in your own country of residence.
